Affiliate Links

Occasionally, a link to a product available for purchase will be followed by [aff]. This means that this is an affiliate link: if you purchase the product or, occasionally, a different product on the same site after clicking on the link, The Five to Nine will receive a small amount of money in return. Some affiliate programmes store cookies on your browser that remember you originally accessed the site through my affiliate link and will remunerate me on subsequent visits. The Five to Nine has no control how affiliate links ‘behave’ – this is the responsibility of the organisation providing the link.

Affiliate links do not necessarily denote the personal or professional endorsement of a product, publication or service (for example).

Please note that references and reviews may contain affiliate links; however, these will be identified as previously described.

E-mail
WordPress requires that a valid e-mail address be provided in order for you to leave a comment on The Five to Nine and will only be used by the system to notify you of any reply(ies) to your comment(s).

The Five to Nine will not use e-mail addresses supplied for the purposes of leaving comments for any commercial/marketing/promotional purposes, nor disclose these to any third parties, except law enforcement bodies, or other agencies or organisations where required to by law, for lawful purposes.

Links

There is no need to leave link(s) to your blog/website in your comments as these will automatically link to this in the name section when all fields are filled in.

Please do not leave a number of links in a comment unless these are directly related and relevant to the post on which you are commenting. If you repeatedly add a number of unrelated and irrelevant links to any post(s) on which you are commenting, or engage in nothing more than blatant self-promotion without making a contribution to discussion taking place, your IP address will be blacklisted.

Do not leave links in comments leading to malicious or illegal content. If you are found to have left such a link, your IP address will be blacklisted and all relevant information made known to an appropriate law enforcement body.

Do not attempt to leave affiliate links in your comments. If you are found to have somehow left an affiliate link in a comment, your IP address will be blacklisted.

Please note that The Five to Nine reserves the right to remove any link(s) from any comment(s). Where this occurs, the link will be replaced with [link removed]. If you find that a link has been removed from a comment you have left on The Five to Nine and wish to discuss the reason(s) behind this, please get in touch via the General Enquiries page.

Manners

When replying to a post or comment, please remember to extend to others the same politeness and courtesy you would expect them to extend to you. Remember that as an opinion does not constitute a fact, by their very nature they can be neither right nor wrong and we should attempt to be as accommodating as possible with those whose viewpoints conflict with or contradict our own. Constructive criticism is always welcome, provided this is delivered in a fair and objective manner. Sycophantic praise of The Five to Nine is greatly encouraged despite being fundamentally pointless, as flattery will not get you anywhere.

Please note that The Five to Nine reserves the right to not publish a comment where this is believed to be antagonistic, discriminatory, insensitive, insulting, libellous or offensive (this list is not exhaustive, and such comments are grouped together under the heading ‘inappropriate comments’). This action will be taken with neither notice nor explanation provided to the comment’s author, and there is no obligation for The Five to Nine to provide this. If any site user repeatedly submits inappropriate comments, their IP address will be blacklisted. Where a comment’s contents appears to be in breach of one or more laws, legal advice will be sought and, if found to be in breach of one or more laws, all relevant information made known to an appropriate law enforcement body.

Moderation

The first comment you make on The Five to Nine will be automatically held for moderation. Following its approval (conditional on content), your future comments should be automatically approved if you use the same name and e-mail combination each time.

If, following the approval of your comment, you conduct yourself in a negative way (please see the previous section), your IP address will be blacklisted.

If you are concerned that your legitimate comment has been mistakenly identified as spam, please see the below section.

Spam

The Five to Nine uses Akismet in order to combat spam comments. In addition to this, WordPress automatically records the IP address associated with each comment left; those related to spam comments will be blacklisted.

If you suspect that a spam comment has made its way onto a post, or if you are concerned that your legitimate comment has been mistakenly identified as spam, please let The Five to Nine know through the General Enquiries page. Remember to include the URL of the post concerned. The Five to Nine will only reply to messages concerning the potential identification of legitimate comments as spam, and offers thanks in advance for any expression of concern received relating to potential spam comments from other sources on The Five to Nine posts.

External Content

The Five to Nine will contain links to external content and third party websites, added for no other reason than the convenience of the visitor and not intended in any way to denote a personal or professional endorsement of a product, publication or service (for example). Watermarks

Watermarks on full-size images from external sources used on The Five to Nine will not be removed out of respect for the intellectual property of the original creator/owner/publisher. Where it becomes necessary to crop an image from an external source prior to publishing and this means a watermark present is lost, it is hoped that the fact the image will be appropriately credited and linked to a relevant site or profile (where applicable) will be acceptable. If your image has been cropped for use on The Five to Nine resulting in the loss of a watermark present and you wish to discuss this, please get in touch via the General Enquiries page.

Watermarks on full-size images that are © Tom West/ The Five to Nine may not be removed under any circumstances. If it is found that a watermark present on an image that is © Tom West/ The Five to Nine has been removed, action appropriate to the offence will be taken. Where appropriate, this may include legal/civil action to protect my intellectual property and authorship rights. Having said this, I recognise that it may be necessary to crop an image prior to publishing that might mean a watermark is removed. In these cases, it is acceptable to publish a cropped image providing this is appropriately credited and includes a link back to The Five to Nine.

Referencing and Sharing

Plagiarism

If you are found to have plagiarised any content that is © Tom West/The Five to Nine, action appropriate to the offence will be taken – please note that this may include legal/civil action to protect intellectual property and authorship rights. If you are found to have plagiarised any content that is © any other author on The Five to Nine, it will be up to them to determine if any action appropriate to the offence will be taken, as well as the form this would take.

Sharing on Social Media Platforms (Social Media Exception)

Full posts may be shared on social media platforms as per appropriate and typical behaviours. If you are not the original author of a post, you should not imply authorship or ownership of this, nor of any post to which you provide a link. If you have shared a post from The Five to Nine and inappropriately implied your authorship or ownership of this, action appropriate to the offence will be taken – please note that this may include legal/civil action to protect the intellectual property and rights of the original author.

Concerning media inserted into posts on The Five to Nine: put simply, please be responsible and share from the original source, i.e. please do not separate media from posts on The Five to Nine and share these independently, as it may impact on intellectual property rights, and/or cause the item(s) in question to lose contextual value.

Use of Material External to The Five to Nine on the site

Whenever The Five to Nine would like to incorporate a significant amount of written material or a piece of media external to the site (hereafter referred to as ‘external material’) into a post, its source will always be checked for a policy relating to its dissemination and reproduction and, where reasonable and appropriate, this will be followed in an attempt to obtain the necessary permission(s) to use this. Where such a policy is not apparent or is not found, a reasonable and appropriate attempt will be made to contact the original creator (or an authorised representative such as a publisher) of the external material The Five to Nine wishes to use in order to obtain permission to use this.

Where neither a policy relating to the dissemination of external material nor details of its original creator or authorised representative are found, or in cases where The Five to Nine does not receive a response to a request sent concerning the use of external material in a post*, The Five to Nine may choose to use this in the manner detailed in the original request for its use. In these instances, The Five to Nine will attempt to limit the amount of external material used as much as possible.

*If a request that is made to use external material does not receive an answer within one calendar week (or timescale stated in any policy on its original source), The Five to Nine may choose to interpret this as consent to use said external material in the manner detailed the original request for its use.

Any and all external material incorporated into a post or posts on The Five to Nine will be referenced/attributed as fully as possible, using all appropriate and relevant information accessible and available at the time of its use.

If you find your original material appears unreferenced, incorrectly referenced or used without your explicit consent and wish to enter into discussion about this, please get in touch with Tom West directly at ‘hello [at] thefivetonine [dot] com’ placing ‘referencing query’ in the subject line. Please note that you will be required to prove authorship/ownership of the work before any request is fulfilled. It is asked that you take into consideration the spirit of how your work is being used before you place a request to have your original material removed from The Five to Nine, if this is the nature of your contact.

The Five to Nine reserves the right to turn part or all of a reference into an affiliate link, where a copy of the work being referenced is available for general purchase and an affiliate scheme in which The Five to Nine is taking part is applicable.

Use of Material that is © Tom West/The Five to Nine on External Sites

If you wish to use any content that is © Tom West/The Five to Nine, whether it is hosted on The Five to Nine or a platform external to the site, please get in touch with Tom directly at ‘mail [at] thefivetonine [dot] com’ placing ‘content use request’ in the subject line. Please include details of the content you wish to use (please include the URL of the post on The Five to Nine or the content held on another platform), the nature of its intended use, the site/platform on which it would be used and your full contact details. Requests without this information will not be considered; you will be instructed to submit a new request containing all the information detailed above and may not use any content that is © Tom West/The Five to Nine until this has been granted.

No reasonable request will be refused, providing the content will not edited or altered in any way (with the exception of translations and rendering the original text in a variant of English such as American or Australian), be fully referenced and attributed, have its original context made clear and not used for any malicious or illegal purpose. Please note that it may take up to two calendar weeks to reply to any request; please do not use any content that is © Tom West/The Five to Nine whilst you are waiting for a reply. If your request is refused, you will be provided with an explanation why, and may not use any content that is © Tom West/The Five to Nine according to the terms of your original request. You may submit a new request with modified terms only if invited to do so.

If, having granted a request to use content that is © Tom West/The Five to Nine, this is found to have been edited or altered beyond a simple translation, not have been fully referenced and attributed, have had its original context not made clear or have been used for any malicious or illegal purpose, action appropriate to the offence will be taken. Where appropriate, this may include legal/civil action to protect intellectual property and authorship rights.

PLEASE NOTE

If you wish to use media you found on The Five to Nine that originates from an external source, it is entirely your responsibility to obtain, where applicable, appropriate and possible, permission to do so from its author/publisher and to credit/reference it appropriately and completely. Its use on The Five to Nine should not imply the original creator’s consent for it to be re-used or disseminated once again. The Five to Nine is in no way responsible for any consequences of you failing to abide by this advice.

Obvious exceptions to the Referencing and Sharing policy apply, i.e. the use of content external to The Five to Nine that is in the public domain, or the use of simple quotes or limited material where the context in which the original content was published remains clear and in which ‘fair dealing’ applies. Any queries about the use of material in either of these contexts should be made through the General Enquiries page.

Review Policy

Making a submission for review on The Five to Nine means you acknowledge, accept and agree to abide by any and all review policies (including any and all future amendments) on this page and, where indicated and applicable, any and all policies that appear elsewhere on The Five to Nine. New policies may be added and existing policies modified or removed at any time and without warning; any such addition, modification or removal will be made known through the Updates page.

Nature of Reviews on The Five to Nine

Reviews of products, publications, events, exhibitions and services on The Five to Nine are intended to provide its readers with, primarily, independent and objective advice, information and overviews. The Five to Nine reserves the right to publish the personal opinion and/or subjective details of a review author’s experience alongside any objective content, but this would not be intended to override this; it would be there for supplementary and secondary information purposes only. No person, agent, brand or organisation submitting for review may contribute to the review in order to eliminate the potential for conflict of interest and to retain impartiality.

It must be noted that a review containing positive feedback indicates neither a personal or professional endorsement nor recommendation, much in the same manner that a review containing negative feedback does not indicate the opposite. Those submitting for review must acknowledge and accept that the final review might contain either a neutral outcome, where positive and negative feedback is in balance, or either a substantially positive or negative outcome. No review will be edited or removed as a result of a straightforward disagreement or a personal sense of unfairness with or about its content.

The Five to Nine will not intentionally publish any content in a product review that is intentionally factually inaccurate or libellous in any manner. If you are concerned that a review contains intentionally factually inaccurate or libellous material, please contact press [at] thefivetonine [dot] com, placing ‘review issue’ in the subject line and including the full URL of the review in question. The Five to Nine aims to respond to all expressions of concern of this nature within 24 hours.

Disclosure of Origin

The origin of products and/or publications, attendance at events and/or exhibitions, and the use of services reviewed on The Five to Nine will typically fall into one of two categories, and the review will clearly indicate this:

– purchased: where [the subject of the review] was paid for by the author of the review

– complimentary: where [the subject of the review] was provided free of charge following an offer made by an authorised person, agent, brand or organisation, or following a request by The Five to Nine to an authorised person, agent, brand or organisation

Affiliate Links in Reviews

Where a review is published on The Five to Nine of a product or publication where this was purchased, and not complimentary, the right is reserved to post an affiliate link to this in the body of the review. Please note that any instance(s) of this do not indicate any personal or professional endorsement or recommendation.

The Five to Nine will not publish ‘blind reviews’ – this is defined as a review based on a product or publication sent in without any prior contact from an appropriate and authorised person, agent, brand or organisation. It is acknowledged that items for review might be received without prior contact from an appropriate representative; there is no obligation for any such item to be reviewed on The Five to Nine . Please copy and paste the following links into your browser to read more about:

– ‘no follow’ links: http://support.google.com/webmasters/answer/96569?hl=en

Areas of Review

It is recommended that any submission for review be associated with one or more of The Five to Nine’s standing themes and areas of interest; however, this should not preclude the consideration of subject matter that sits outside the list found on that page. Please note that the list of standing themes and areas of interest might evolve as The Five to Nine develops; changes will be made known through the Updates page.

Payment for Reviews

Please note that The Five to Nine will not accept payment for reviews under any circumstances. Any correspondence received concerning a paid-for review will be discarded without response and details of the person, agent, brand or organisation that has sent such correspondence will be held on file. By sending correspondence relating to paid-for reviews, you agree that The Five to Nine has the right to disclose full details of any request(s) for paid-for reviews where it is believed that substantial, appropriate and lawful reasons to do so have been provided.

Deadlines for Reviews

The timeline for completion of a review is variable, as it will typically depend on the nature of the review’s subject matter. The aim is for any review to be completed and ready for publishing within two calendar following of the receipt of the submission for review; however, there is no formal obligation to accommodate this. No person, agent, brand or organisation submitting for review is permitted to set a deadline for its completion.

Launch Dates and Embargoes

The Five to Nine will respect embargoes, providing accurate information concerning these is made explicit, in writing, and accompanies a submission for review. It remains the sole responsibility of the person, agent, brand or organisation submitting for review to supply this. Where no embargo is indicated at the time of submission for review, this will be published immediately upon its editorial approval.

Where possible, and where no embargo is indicated, a review will be published in advance of the launch date of a product, publication or event in order to help generate publicity; please note that there is no formal obligation to accommodate this.

Ownership of Item(s) Submitted for Review

Once an item has been submitted for review (including any product or publication sent in without any prior contact from an appropriate and authorised person, agent, brand or organisation), it is agreed that this becomes wholly and irrevocably the property of The Five to Nine; it is agreed that items submitted for review will not be returned and, at The Five to Nine’s discretion, may be used as prizes in competitions or giveaways that might be hosted on The Five to Nine . In these cases, The Five to Nine will not make any item submitted for review available to any competition or giveaway winner before any supplied launch date or embargo.
